We do not accept responsibility if information presented on this site is not accurate, complete or current. The information provided is general and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk; for example colours may vary and hand crafted items are by their nature, variable in appearance.
This site may contain historical information (such as blog prices) which are not necessarily current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we are not obligated to update any or all information on our site. Monitoring changes to our site is the sole responsibility of the user.

We reserve the right to change/modify/increase/decrease the price of goods and/or postage without notice.  Goods and services may be discontinued at any time.  We are not liable to you or any third party for any modification in price or discontinued product.

Links to third party websites may be included within this site, however we accept no responsibility for the content or accuracy of the information contained within these third party sites.  The user should consult the terms and conditions of the third party sites before use and any complaints, concerns, questions etc. arising from third party sites should be directed to the third parties.

4. Returns and Right to cancel Web Orders
(For store purchases please contact our customer service team, as different rules apply)

You have the right to cancel the purchase of goods without having to give a reason at any time within the "cooling off period" of fourteen days, beginning on the day after you receive the goods.  All returns within this period will receive a full refund (excluding costs for return postage - see below for further details).

If you are in possession of the goods you are under the duty to retain them and take reasonable care of them. You must send the goods back to us to our contact address at your own cost as soon as possible once you have cancelled the contract.  All goods must be returned to us in their original packaging and in a saleable condition. 

When returning goods please include your name, order number and list of items to be returned.

All goods remain your responsibility until they are received by us, so please ensure that goods are adequately packaged and as we are not liable for any losses incurred during transit we recommend a tracked service.

We reserve the right to make a charge not exceeding our direct costs of recovering the goods if you do not return the goods or return them at our expense. 

Once you have notified us that you wish to cancel the contract, any sum debited to us will be refunded to you as soon as possible and in any event within 30 days of your cancellation.

You will not have any right to cancel a purchase for the supply of any of the following goods:

  • for the supply of goods the price of which is dependent on fluctuations in the financial market which cannot be controlled by the retailer.

  • for the supply of good made to your specifications or clearly personalised or which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly.

  • for the supply of audio or video recordings or computer software if they are unsealed by you.

  • for the supply of newspapers, periodicals or magazines.

  • for gaming, betting or lottery services.

  • for hygiene reasons we cannot accept the return of earrings unless faulty or damaged.

5. Damaged and Missing Items

In the unlikely event that goods are received damaged or faulty, please endeavour to contact us within five working days of receipt of the goods, including a photo where applicable and we will advise you how to proceed.

6. Notices 

All notices you send us must be sent to the contact details on this site. We may give notice to you at either the email or postal address you provide to us when making a purchase. (Notice will be deemed received and properly served 24 hours after an email is sent or three days after the date of posting of any letter.) In providing the service of any notice, it will be sufficient to prove, in the case of a letter, that the letter was properly addressed, stamped and placed in the post and, in the case of an email that the email was sent to the specified email address of the addressees.

7. Prohibitions

All users are prohibited from using the site or its content as outlined in the following, not exhaustive, list.  Failure to comply with these conditions will result in the termination of your use of our services.

  • for any unlawful purpose/act or to solicit others to perform or participate in any unlawful acts;

  • to violate any laws or local ordinances;

  • to use the website as a means to upload or transmit viruses or any other type of malicious code or software for any reason, including the collection or tracking of the personal information of others;

  • to spam, phish, pharm, pretext, spider, crawl, or scrape or commit any other unlawful internet based act;

  • to violate or obtain our intellectual property rights or the intellectual property rights of others;

  • to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate by any means;

  • to submit false or misleading information;

  • for any obscene or immoral purpose;

8. Conclusion

These terms are governed by English law. Any contract for the purchase of goods from this site and any dispute or claim arising out of or in connection with any such contract will be governed by English law. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident in Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident in Scotland you may also bring proceedings in Scotland.

 

9.  Click & Collect

Orders placed for click and collect will be made available for collection as soon as possible during our stated opening hours; outside of these times, your order will be available to collect the next working day. You will receive a notification email when your order is ready to collect. Goods should be collected from Marmalade Meringue, 82 Castle Street, Hinckley, LE10 1DD. We will hold your items for a maximum of 14 days, after which we will cancel your order and return goods to stock, unless organised with us otherwise.
